McVitie's - 'Adopt a Penguin'

FULL TERMS AND CONDITIONS:

Participation

1. The Competition is open to residents of the UK, Channel Islands (CI) or Isle of Man (IOM), excluding employees and their immediate families of United Biscuits (UK) Limited, its agents and anyone professionally connected with the Competition. No purchase necessary.

2. By accepting the Terms & Conditions participants agree to have their joke published on the website.

3. Participants under 16 years old must have permission from a parent or guardian to enter and use their parent or guardian’s email address for entry.

4. The Penguin “Get your Joke on pack” Competition is only available online.

5. Dates for submitting your “Penguin Joke” online are September 23rd 2010 to 30th November 2010 inclusive.

6. There is no limit to the number of times you can submit a joke but they have to be different jokes and there can only be one winning entry per person.

How to Enter

7. Visit www.penguinbiscuits.com, and proceed to the Competition entry page where you will be required to complete an online entry per the steps below:

a. Basic information: You will be asked to provide your full name and email address;

b. Joke: enter your joke ( 250 words or less);

c. Accept the terms and conditions; and

d. Confirm that you are aged 16 or over; or

e. Confirm that you are under 16 and have your parent or guardian’s permission.

8. All Competition Entries must be received by midnight, 30th November 2010 in order to be included in the Competition. Only entries via the official website and competition entry page above will be accepted.

9. Entries made in any manner inconsistent with these Terms and Conditions, will be declared invalid and disqualified from this Competition.

Entries must not:

A. Be violent or negative of any ethnic, racial, gender, religious, professional or age group, profane or obscene;

B. Be about the use of alcohol, illegal drugs, tobacco, firearms/weapons, any activities that may appear unsafe or dangerous, or any particular political agenda or message;

C. Be offensive or be about hate;

D. Defame, misrepresent or contain negative remarks about the Promoter or its products, or other people, products or companies;

E. Contain copyrighted materials owned by others; or

F. Violate or depict a violation of any law.

Any inappropriate or offensive material may be reported to the appropriate authorities.

10. The Promoter reserves the right to permanently remove any material that is deemed by the Promoter in its sole and absolute discretion to be (a) in breach of the above clause or (b) distasteful, degrading or will in any way cause offence.

11. By submitting an entry participants agree to assign copyright and all other intellectual property in the joke to the Promoter and warrant that the Promoter and its agents have the unrestricted right to publish, use, adapt, edit and/or modify the joke in any way, in whole or in part, without limitation and without further consideration or notice to the entrant.

12. By entering, participants accept that their entry is gratuitous and made without restriction, and will not place the Promoter under any obligation.

Prize Attribution

13. Entries received by 30th November 2010 will be independently judged by a panel, which will include at least one member independent of the Promoter.

Entries will be judged on the basis of those unique entries that are deemed to be most apt, creative, genuine and relevant to the brand.

Prizes: 8 winners will each have their winning entries printed on Penguin packs.

Winners only will be notified by email by 15th January 2011.

Appropriate jokes will be uploaded to the website. The Promoter reserves the right to restrict further entries of similar or the same jokes and these will not necessarily be uploaded.

General Provisions

14. No cash or other prize alternatives are available.

15. Names and counties of Competition winners and their winning entries will be available on www.penguinbiscuits.com for a minimum period of three months.

16. Winners may be required to participate in unpaid publicity concerning this Competition.

17. The Promoter cannot be held responsible for network, computer hardware or software failures of any kind, which may restrict or delay entry.

18. Participants will be asked on the promotional website if they would like to opt in to receive email updates on the latest news and information from United Biscuits. Should the participant opt-in and decide at a later date that they would no longer like to receive these updates; they should click on the opt-out link available in the email received.

19. The Promoters decisions in all matters to do with the Competition will be final and no correspondence will be entered into.
